C. HOURLY AND/OR
RUN HIRE
1. Subject to
subclause 4. hereunder where the contract carrier is performing work while on
hourly hire or performing run work, the contract carrier shall be paid an hourly
rate equal to the rate provided for in Schedule I for the equivalent class of
vehicle. This rate shall be paid for
all time between the commencement of work on hourly hire or whilst performing
run work until the completion of such work, whether or not during that period
the contract carrier is actually carrying goods on the vehicle (i.e.
"continuous hire"). For the
purposes of this clause, time shall be calculated to the next quarter of an
hour.
2. Whenever a
contract carrier is performing work pursuant to subclause (1) of this clause, he/she shall be paid for at
least one (1) hour’s work, irrespective of whether this time was actually
worked.
3. Whenever a
contract carrier performs work pursuant to subclause (i) of this clause any
additional "ad hoc" work shall be paid at full Schedule III rates.
4. Where a
contract carrier is performing work on an exclusive hire basis, the carrier
shall be paid in accordance with clause 15 of this determination.
2. Delete the
words "plus 4.5%" in clause 15.1.
3. This
variation shall take effect on and from 1st March 2006.
