VARIATION
1. Delete
Schedule VI - Fuel Levy, of the contract determination published 9 November
2001 (329 I.G. 248), and insert in lieu thereof the following:
Schedule VI - Fuel Levy
1. In addition
to all other remuneration received by the contract carrier the principal
contractor shall pay the contractor an additional amount as a fuel levy. The fuel levy amount shall be equal to 2% of
the carrier's gross remuneration for each pay period observed by the principal
contractor.
2. If the Caltex
Metro (New South Wales) Card Price for unleaded petrol exceeds $0.82 cents per
litre (excluding GST) for a calendar month but calculated on an average basis,
an application may be made for a contract determination requiring the principal
contractor to pay the carrier, in addition to all other remuneration received,
an additional amount as a fuel levy equal to a specified percentage of the
carrier's gross remuneration for each pay period observed by the principal
contractor in place of the levy contained in clause 1.
3. The
percentage amount of the fuel levy shall be determined by the average cost of
unleaded petrol, for the five days preceding the time the application is
determined, in accordance with the following table.

4. If the
Average Caltex Metro (NSW) Card Price for unleaded petrol (excluding GST)
exceeds 143 cents per litre the Transport Industry - Courier and Taxi Truck
Industrial Committee shall make a contact determination for a fuel levy of an
mount in excess of 5%.
5. The principal
contractor shall not offset the fuel levy amount against any remuneration
payable to the carrier or use the fuel surcharge amount in the calculation of
the carrier's safety net entitlements.
6. The fuel levy
amount shall be paid to the carrier at the same time that the principal
contactor pays the carrier remuneration for the pay period observed by the
principal contractor. The principal
contractor shall specify the fuel levy amount paid to the carrier on the pay
record issued to the carrier pursuant to clause B of Schedule V to this
determination.
7. Once a
contract determination for a fuel levy is made it shall remain in force until
it is varied or abolished
2. This
variation shall take effect from the first pay period to commence on or after 9
May 2002.
